Terms of Use

1. Acceptance of These Terms

These Terms of Use ("Terms") are an agreement between you and Owners Quote ("Owners Quote," "we," "us," or "our"). They govern your use of ownersquote.com (the "Site"), the phone numbers shown on the Site, and the free quote request service we offer through them (together, the "Service").

By visiting the Site, calling one of our numbers, or submitting a quote request, you agree to these Terms and to our Privacy Policy, which is part of these Terms. If you do not agree, please do not use the Service. Please read these Terms carefully; they include disclaimers and a limitation of our liability in Sections 8 and 9.

2. The Service

Owners Quote is a matching and referral service. When you tell us about a home project, we share your request with up to four independent, third-party home service providers ("partner providers") that serve your ZIP code and handle that type of work. Those providers may then contact you to learn more and offer a quote. The Service is free for homeowners. We may receive a fee from partner providers in connection with the requests we deliver.

To be clear about what we are not:

  • We are not a contractor, broker, or licensed trade professional. We do not perform, supervise, or guarantee any work.
  • We do not employ the partner providers, and they are not our agents. We do not set their prices, schedules, or terms.
  • We do not guarantee that any provider will contact you, offer a quote, be available, or accept your job. The number of providers that respond depends on your location and project.
  • We do not guarantee the pricing, licensing, insurance, bonding, qualifications, or quality of any provider or its work. Any cost ranges on the Site are typical national figures for general planning and are not quotes or offers.
  • We do not endorse, recommend, or rank individual providers.

You are responsible for evaluating any provider before you hire them. We strongly encourage you to verify licensing with your state or local licensing board, confirm current insurance, check references and reviews, get every quote in writing, and read any contract carefully before signing.

3. Eligibility

To use the Service you must:

  • Be at least 18 years old.
  • Be located in the United States and be requesting services for a property in the United States.
  • Own the property described in your request, or be authorized by the owner (for example, as a tenant with permission, a property manager, or a family member acting on the owner's behalf) to request quotes for it.

By submitting a request, you confirm that you meet these requirements. The Service is not directed to anyone under 18, and we do not knowingly accept requests from minors.

4. Your Information and Consent to Be Contacted

Accurate information. You agree to provide true, current, and complete information in your request and to use your own name and contact details. You confirm that you are the regular user of the phone number and email address you give us, or that you have the authority to provide them, and you agree to tell us if that phone number changes or is reassigned.

Consent to be contacted. Every quote request form includes a consent checkbox with specific language. When you check that box and submit the form, you give Owners Quote and up to four of our partner providers your express written consent to contact you at the phone number and email address you provided, including through automated technology, AI voice, and pre-recorded messages, about your request, even if your number is on a Do Not Call list. Consent is not a condition of purchase, and message and data rates may apply. The exact consent language shown on the form controls, and we keep a record of it with your request. Our Privacy Policy explains how to withdraw consent at any time, including by replying STOP to texts.

How we use your information. Our Privacy Policy describes the information we collect, how we share it with partner providers and service vendors, the cookies and pixels we use, and the choices you have. By using the Service, you acknowledge that you have read it.

Call recording. Calls to the phone numbers on the Site are routed through tracking numbers and may be recorded or monitored for quality, training, and compliance purposes. By continuing a call after any recording notice, you consent to the recording.

5. Acceptable Use

You agree to use the Service only for its intended purpose: requesting quotes for real home projects at a property you own or are authorized to manage. You agree not to:

  • Submit requests that are false, misleading, duplicative, or on behalf of someone who has not authorized you, or use a phone number or email address that is not yours to use.
  • Submit requests as a contractor, marketer, or competitor to obtain information about our partner providers or our business, or to test or harvest our systems.
  • Use bots, scripts, scrapers, or other automated means to access the Site, submit forms, or collect content or data from it.
  • Interfere with the Site's operation, including by probing or testing its security, bypassing rate limits or spam protections, introducing malware, or placing an unreasonable load on our systems.
  • Copy, frame, mirror, or republish the Site or its content without our written permission.
  • Use the Service to harass, threaten, or defraud any provider or any other person, or to violate any law.

We may investigate suspected violations, refuse or remove any request, and block access to the Site without notice.

6. Partner Providers Are Independent

Each partner provider is an independent business that is solely responsible for its own communications, estimates, pricing, scheduling, licensing, insurance, permits, workmanship, warranties, and compliance with the law. Any quote, agreement, or contract for services is solely between you and the provider you choose. Owners Quote is not a party to that agreement, does not receive or handle payments for the work, and has no responsibility for how the work is performed.

If you have a dispute with a provider about its quote, its work, its payment terms, or its conduct, you agree to resolve that dispute directly with the provider. You release Owners Quote and its owners, officers, employees, and affiliates from any claims, demands, and damages of every kind arising out of or connected with any dispute between you and a partner provider, to the fullest extent permitted by law. We do welcome feedback about your experience, and we may use it in deciding whether to keep working with a provider, but we are not obligated to act on it.

7. Intellectual Property

The Site and everything on it, including text, graphics, logos, the "Owners Quote" name and wordmark, page layouts, cost guides, and software, are owned by or licensed to Owners Quote and are protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to view and use the Site for the purpose of requesting quotes for your own home. You may not use our name, logo, or content in any way that suggests we endorse you or your business, or otherwise without our prior written permission.

If you send us feedback or suggestions, you agree that we may use them without any obligation to you.

8. Disclaimers

THE SERVICE, THE SITE, AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, OWNERS QUOTE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Without limiting the above, we make no warranty that the Site will be uninterrupted, error-free, or secure; that any provider will contact you or offer a quote; or that any provider is licensed, insured, qualified, or will perform work to your satisfaction. Cost ranges, articles, and FAQs on the Site are general information only, are not quotes or professional advice, and may not reflect conditions in your area. Actual prices are set solely by the provider you choose and depend on your specific project.

Some states do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OWNERS QUOTE AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PROPERTY VALUE, ARISING OUT OF OR RELATING TO THE SERVICE, THE SITE, OR ANY PROVIDER OR WORK, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE TOTAL AMOUNT YOU PAID TO OWNERS QUOTE IN THE 12 MONTHS BEFORE THE CLAIM AROSE. BECAUSE THE SERVICE IS FREE FOR HOMEOWNERS, THAT AMOUNT IS ORDINARILY $0.

These limitations are a fundamental part of the agreement between you and us and apply even if a remedy fails of its essential purpose. Some states do not allow the limitation of liability for certain damages, so some of the above limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Owners Quote and its owners, officers, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) information you submit that is false, misleading, or that you were not authorized to provide, including a phone number or email address that does not belong to you; (c) your misuse of the Service; or (d) any agreement, dispute, or dealings between you and a partner provider. We may take over the defense of any matter subject to indemnification, in which case you agree to cooperate with us.

11. Governing Law and Dispute Resolution

Governing law. These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law rules that would apply the law of another jurisdiction.

Talk to us first. Most concerns can be resolved quickly and informally. Before filing any claim against Owners Quote, you agree to email us at hello@ownersquote.com with the subject line "Dispute Notice," describe the problem and what you would like us to do, and give us 30 days to work with you toward a resolution. We will do the same before filing a claim against you.

Venue. If we cannot resolve a dispute informally, you and we agree that any lawsuit will be filed exclusively in the state or federal courts located in the State of California, and you consent to personal jurisdiction in those courts. Either party may instead bring an individual claim in small claims court in the county where you live or where we are located, if the claim qualifies.

Time limit. To the extent permitted by law, any claim arising out of or relating to the Service must be filed within one year after the claim arose, or it is permanently barred.

Nothing in this section prevents you from filing a complaint with a government agency, such as your state Attorney General or the Federal Communications Commission, or limits any rights you have under state or federal consumer protection laws that cannot be waived.

12. Changes to These Terms

We may update these Terms from time to time as the Service, our partner network, or the law change. When we do, we will post the revised Terms on this page and update the effective date at the top. Changes apply going forward from the new effective date and do not change the terms that applied to a request you already submitted, except where the law allows. If you keep using the Site after a change takes effect, you accept the updated Terms. If you do not agree to a change, please stop using the Service.

13. Termination

You can stop using the Service at any time. You can also ask us to delete your request or stop contacting you as described in our Privacy Policy and on our Your Privacy Choices page.

We may suspend or end your access to the Service, decline or discard any request, or block any phone number, email address, or IP address at any time and for any reason, including suspected violations of these Terms, without notice or liability to you. Sections 6 through 11 and any other provisions that by their nature should survive will continue to apply after termination.

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy and the consent language on our forms, are the entire agreement between you and us about the Service. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
